Section 76
Stop work in case of immediate danger
(1) If any work is not stopped immediately, if there is a physical injury or danger to the worker or someone else, or if there is a serious impact on his health or there is unexpected damage or loss of any equipment, object or substance, the worker involved in such work shall inform the employer or It should be given to the responsible person according to section 71.
(2) After receiving the information as per sub-section (1), the employer or the responsible person shall immediately give appropriate instructions in this regard.
(3) If the employer or the responsible person is not immediately available to give the information as per sub-section (1), the worker himself can stop such work.
(4) In accordance with sub-section (3), the worker who stops work shall immediately inform the employer and the responsible person through the fastest means.
(5) After receiving the information according to sub-section (4), the employer or the responsible person shall investigate the matter immediately and eliminate or minimize the danger created by it.
(6) If there is any dispute between the worker and the employer regarding whether or not there is an immediate danger to stop any work and whether or not the arrangements made to prevent or reduce the danger are sufficient or not, any party may apply to the labor office for the resolution of such dispute.
(7) If an application is received according to sub-section (6), the office shall investigate the matter and listen to both parties, if necessary, and take the evidence and resolve such dispute.
(8) According to sub-section (7), the decision of the office to settle the dispute shall be final and such decision shall be accepted by both the employer and the workers.
(9) Notwithstanding anything else written in this section, work shall not be stopped for the purpose of inflicting damage, suffering or seeking compensation to the employer.
(10) Employers may engage workers in other work subject to their terms of service during work stoppages in accordance with this clause.
